Chapter I General Provisions

Article 1 These measures are formulated in order to regulate UAV flight activities in Shenzhen, guide units and individuals engaged in UAV flight activities to fly legally, improve flight management efficiency, maintain flight order, and ensure air defense and military and civil aviation flight safety

Article 2 pilot areas in Shenzhen:

Article 5 The Air Force Staff Department of the southern theater is specifically responsible for organizing and implementing the pilot work of UAV flight management in Shenzhen, and the pilot work leading group is responsible for coordinating and solving major problems in flight management. Each department of each unit is responsible for the relevant management of UAV according to relevant regulations and relevant division of responsibilities

Chapter II UAV system

Article 6 UAVs are divided into national UAVs and civil UAVs. Civil UAV refers to the UAV used in civil aviation activities; National UAV refers to UAVs other than civilian UAVs, including UAVs used to perform military, customs and police missions

according to the operation risk, civil UAVs are divided into micro, light, small, medium and large. Among them:

micro UAV refers to a remotely piloted aircraft with an empty weight of less than 0.25 kg, which has the function of altitude maintaining or position maintaining flight, and whose design performance meets the technical requirements of micro power short-range radio transmission equipment with a true height of no more than 50 meters, a maximum level flight speed of no more than 40 km/h, and a radio transmission equipment that meets the technical requirements of micro power short-range radio transmission equipment

light UAV refers to a remotely piloted aircraft that meets the requirements of no more than 4kg of empty aircraft weight, no more than 7kg of maximum take-off weight, and no more than 100km/h of maximum level flight speed, and has the ability to maintain airspace and be reliably monitored in line with airspace management requirements, but does not include micro UAV

small UAV refers to remote-controlled aircraft or autonomous aircraft with an empty weight of no more than 15 kg or a maximum takeoff weight of no more than 25 kg, but does not include micro and light UAVs

medium UAV refers to a remotely piloted aircraft or autonomous aircraft with a maximum takeoff weight of more than 25 kg but not more than 150 kg and an empty weight of more than 15 kg

large unmanned aerial vehicles refer to remotely controlled aircraft or autonomous aircraft with a maximum takeoff weight of more than 150 kg

Article 7 the airworthiness management of medium-sized and large UAVs shall be implemented by the competent civil aviation authority under the State Council according to law. The specifications of micro, light and small UAV production enterprises, product manufacturing standards and product safety shall comply with the relevant provisions of the competent industrial department of the State Council

civil UAVs other than micro UAVs shall have a unique product code in accordance with the provisions of the competent industrial department of the State Council

micro, light and small UAVs should be certified by a legally established certification body before being put on the market; After being put on the market, if defects are found, the producers and importers shall recall them according to law

Article 8 units and individuals selling civil UAVs other than micro UAVs shall file with the public security organ, verify and record the relevant information of the purchasing unit and individual (purchaser's identity information, contact information, UAV model, product serial number, etc.), and report to the public security organ regularly

logistics and delivery enterprises should register the delivered goods and the identity information, contact information, address and other information of the sender and recipient when receiving and mailing civil UAVs, engines, control chips and other important parts, and report to the public security organ. Units and individuals who purchase civil UAVs other than micro UAVs shall pass the real name authentication and cooperate with the verification of relevant information

Article 9 civil UAV registration management includes real name registration and nationality registration

civil UAVs other than micro UAVs should be registered with the competent civil aviation authority under the State Council in real name, and their nationality should be registered in accordance with the relevant management rules of UAVs

the competent civil aviation authority under the State Council shall share relevant information about registration management with flight control, public security, industry and information technology departments

when the registration information of civil UAV changes, its owner shall change in time; In case of loss, theft or scrapping, it shall apply for cancellation in time

Article 10 the use of civil UAVs for commercial flight activities shall apply to the regional administration of civil aviation and obtain the business license in accordance with relevant regulations

Article 11 the civil UAV manufacturer shall clearly mark the legal operation instructions and risk prevention tips on the outer packaging of micro and light UAVs in accordance with the requirements of the competent industrial department of the State Council, and mark the type of UAV on the body

Article 12 units or individuals engaged in small, medium and large UAV flight activities and using light UAVs to engage in business activities shall purchase third party insurance in accordance with the provisions of the insurance administration department of the State Council

Article 14 the relevant departments shall separately formulate the administrative measures for the classification, finalization, registration, identification, insurance and other aspects of national UAVs

Chapter III UAV driver management

Article 15 light UAV drivers should be at least 8 years old, and under 14 years old should have adult on-site supervision; The pilot of a small UAV should be at least 16 years old; Pilots of medium-sized and large unmanned aerial vehicles should be at least 18 years old

Article 16 the personnel operating the micro UAV shall master the operation and compliance requirements

to fly a light UAV in the appropriate airspace, you need to master the operation compliance requirements and risk warnings, and be familiar with the operation instructions; If you fly beyond the airspace suitable for flight, you need to participate in the theoretical training part of safety operation training, and obtain the certificate of theoretical training through examination

the driver of small, medium and large unmanned aerial vehicles operated independently shall obtain a safety operation license

the operators of distributed UAV systems or clusters do not need to obtain a safety operation license. The units or individuals organizing flight activities and the management system should accept safety review and obtain a safety operation certificate

Article 17 UAV pilots shall be subject to identity and qualification examination conducted by civil aviation Shenzhen regulatory bureau, Shenzhen public security organ and military aviation flight control department

Article 18 If the drone driver is affected by alcoholic beverages, narcotics or other drugs, which impairs his working ability, he shall not drive the drone

persons who have been criminally punished for intentional crimes are not allowed to serve as pilots of medium-sized and large-scale UAVs

Chapter IV flight airspace

Article 19 the designation of UAV flight airspace should follow the principles of overall allocation, flexible use, safety and efficiency, fully consider national security, social benefits and public interests, scientifically distinguish the flight characteristics of different types of UAVs, focus on isolated operation, and take into account the needs of some integrated flights. The horizontal and vertical range and use time limit of the flight airspace shall be specified

Article 20 without the approval of the Air Force Flight Control Department of the southern theater, micro UAVs are forbidden to fly in the following airspace:

(1) airspace with a true height of more than 50 meters

(II) the restricted area in the air and the surrounding area of 2000 meters

(III) aerial danger zone and surrounding 1000 meters

(4) within the boundaries of the airport, temporary takeoff and landing points and above the surrounding 3000 meters

(V) above the range of 3000 meters from the national boundary or the actual control line to our side and 100 meters from the Hong Kong border line to Shenzhen side

(VI) above the military restricted zone and the surrounding area of 500 meters, above the military management zone, the party and government organs at or above the municipal level (including) divided into districts, and the supervision sites and the surrounding area of 200 meters

(VII) satellite ground stations (including measurement and control, ranging, receiving, navigation stations) and other facilities requiring special protection of the electromagnetic environment and above the surrounding 1000 meters,

meteorological radar stations and above the surrounding 500 meters

(VIII) above the protection area of important military scientific research, production, testing and storage facilities and the surrounding 500 meters, the control area of nuclear facilities implementing level I and level II physical protection, large enterprises producing and storing inflammable and explosive dangerous goods and large warehouses and bases storing inflammable and explosive important materials, as well as above the surrounding 100 meters, power plants, substations, gas stations and large stations, wharves, ports Above the large-scale event site and the surrounding 50 meters, above the high-speed railway and the 100 meters on both sides, above the ordinary railway, national highway, provincial highway and the 50 meters on both sides

(IX) military aviation ultra low altitude flight airspace

the specific scope of the above-mentioned prohibited airspace for micro unmanned aerial vehicles shall be determined by the Shenzhen Municipal People's Government in conjunction with the southern theater air force flight control department, which shall be updated every six months according to the situation, and the Shenzhen Municipal People's Government shall set up warning signs in accordance with relevant national regulations

Article 21 the following airspace is designated as the airspace under the control of light UAVs:

(I) airspace with a true height of more than 120 meters

(II) the restricted area in the air and the surrounding 5000 meters

(III) the air danger zone and the surrounding area of 2000 meters

(IV) military airport clearance protection area, above the horizontal projection range of the obstacle limitation surface of the civil airport

(V) above the temporary takeoff and landing points of manned aircraft and large unmanned aerial vehicles and the surrounding 3000 meters

(VI) above the 5000 meter range from the national boundary or the actual control line to our side, and above the 500 meter range from the Hong Kong border line to Shenzhen side

(VII) above the military restricted zone and the surrounding area of 2000 meters, above the military management zone, the party and government organs at or above the municipal level (including) divided into districts, and the supervision sites and the surrounding area of 500 meters

(VIII) satellite ground stations (including measurement and control, ranging, receiving, navigation stations) and other facilities requiring special protection of the electromagnetic environment and above the surrounding 2000 meters, meteorological radar stations and above the surrounding 1000 meters
